Qiao WANG is a Senior Associate of Dispute Resolution Team in Guantao Law Firm Beijing office. She joined Guantao in 2011 with focus on domestic and cross-border arbitration, litigation and bankruptcy. She is specialized in disputes arising from international trade, corporate, financial loan and private lending. Whilst she regularly acts for multinational corporations, SOEs and influential private enterprises in Court litigation at all levels in major cities of China, she has also advised in a significant number of international and domestic arbitrations in CIETAC, BAC and HKIAC. She is highly experienced in applications for property and evidence preservations as well as court injunction enforce.
Ms. WANG's recent experience covers a number of complex and high value disputes, including international trade disputes with applicable law of CISG, corporate disputes of sino-foreign joint venture, financial loan disputes from state-owned financial institutions with high values, and complex credit claims disputes during bankruptcy proceedings, etc.
Selected Experience
Representation of Atradius Trade Credit Insurance Inc., one of the most prestigious insurance companies in Europe all well as the second largest one in the world, in its various cases of recovering its credit insurance claims throughout China.
Representation of a SOE in CIETAC of the dispute over a subscription agreement against an overseas equity investment funds, which involves the exit of one of the first overseas RMB funds invested by state-owned enterprises. The disputed contract is complicated and has a long term. Ms. WANG and her team worked out a breakthrough that enables the two sides to finally reach a settlement, which is of significance to protect the benefit of the client and state-owned assets.
Representation of an Asian leading optical technology enterprise in Beijing High Court of the dispute over a purchase contract against LeShi Shareholding. Before LeShi's business situation deteriorated, Ms. WANG advised the client to initiate the legal proceedings and provided strong support for the client to reach settlement agreement and obtain enforceable mediation paper in the shortest possible time, helping the client successfully obtain repayment of nearly 300 million RMB from LeShi, and became the first creditor freezing LeShi's valuable properties amounting to billions of RMB.
Provision of advices to a Taiwan company, VIA Technologies Inc. as defendant on its legal proceedings in Chinese court of recognition and enforcement of Hong Kong Arbitral Awards initiated by a Hong Kong TMT company. Ms. WANG and her team made a comprehensive rebuttal response, later was supported by the court, that the property owned by the defendant's indirect invested subsidiary should not be deemed as the defendant's property. The Supreme Court issued a judicial interpretation specially for this case, which brings reference to cases in this regard.
Representation of series of litigation between a private company and Renhe Investment Holding Co., Ltd, an affiliate of the Hong Kong listed company Renhe Commercial Shareholding Co., Ltd, amounting four billion RMB. Before the substantive trial, Ms. WANG helped the client search valuable properties of the defendant that can fully cover the client’s loss under disputed contracts and applied for property preservations, which well protected the client’s interest.
Representation of International Wood Supplier (Hong Kong) Limited in CIETAC of a dispute against a company registered in the Republic of Lithuania which involves arbitration jurisdiction conflict. During the CIETAC arbitration proceedings, the Lithuania-registered company also submitted a parallel arbitration for the same case to Lithuanian Court of Arbitration (LCA). Ms. WANG and her team worked to raise objections to the jurisdiction of the LCA tribunal and the validity of some parts of the arbitration clause, and successfully persuaded the LCA tribunal to render an award refusing Lithuanian company’s application.
Representation of China Huarong Asset Management Co., Ltd in series of litigation against Huishan Dairy Industry Group, the dispute of which amounts to nearly one billion RMB. The core of these cases is whether the creditor's right secured by the unregistered chattel mortgage shall have priority against other unsecured claims in the bankruptcy proceedings when there is no specific legal stipulations. Ms. WANG and her team provided all-round legal analysis from aspects of current legal provisions, legislative principles, property law theory, and a large number of cases precedent, and finally obtained a ruling in favor of the client.
Representation of a dispute between a Netherlands’ energy company and the Chinese government by attending consultations before it being submitted to ICSID, based on the bilateral investment treatment between the two nations. With the great effort of Ms. Wang and her team working with the client for its commercial negotiations with MOFCOM and related SOEs over months, the client finally reached settlement with the Chinese government and related SOEs which can also enable its continual investment business in China.
Representation of a German steel production Company in HKIAC against a Chinese listed company subsidiary for a dispute in relation to international sale of goods. Ms. WANG and her team helped protect the client’s interest to the greatest extent.
Representation of various of multinational corporates, such as LG Electronics, Bosch Electronics, IBM factoring, Edom Technology (a Taiwan listed company), and Schmiedewerke Gröditz GmbH, etc, in arbitration and litigation over their domestic and cross-border trade.
Representation of various of financial and insurance institutions, such as Hengfeng Bank, China Huarong and Aeon Life Insurance, etc, in their trust fund, commercial paper and integrated credit business disputes.
