Anti-monopoly Law
• Mr. Sun is one of the very few Chinese lawyers who have been actively involved in representing Chinese clients in US antirust litigations. He also has extensive experiences in providing anti-monopoly compliance training to clients and providing anti-monopoly opinions and guidelines to clients in their market strategy development. He has also assisted many international clients in their merger control filing before the Chinese anti-monopoly authorities.
Cross-Border Investment
• Mr. Sun has extensive experience in representing clients to establish WFOEs or JVs in China and abroad. He has represented clients in investment negotiations, drafted contracts, conducted due diligence investigations, and assisted in the filing and approval of the projects before the relevant government authorities. Mr. Sun is also experience in dispute settlement in connection with the establishment, capital injection, operation and liquidation of companies.
International Trade / WTO
• Mr. Sun has extensive experience in international trade practice covering antidumping, countervailing duties, safeguard actions and related trade remedy measures; applicable WTO rules over goods, services, investment, intellectual property and relevant dispute settlement proceedings; and customs law issues such as classification, valuation and country of origin marking. Mr. Sun has worked in more than 30 trade remedy cases initiated by the Chinese government and has accumulated rich experience in assisting clients in a diverse range of cases. He acted as legal counsel for the Chinese Ministry of Commerce in the OECD steel subsidy negotiations and has provided legal advice to the Chinese government in trade barrier investigations.
Representative Experience
• Representing the Ministry of Commerce in its participation in a US antitrust litigation against Chinese producers;
• Providing anti-monopoly compliance training to an air freight JV in China;
• Assisting international clients in their merger clearance before the Chinese anti-monopoly authorities;
• Assisting several Chinese companies in their overseas mining right investment projects;
• Representing a multinational company to settle transaction disputes in China;
• Providing advices to a multinational company in its dispute settlement with its Chinese JV partner.
• Representing the Chinese government as a third party to WTO dispute settlement cases;
• Drafting the rules of evidences for MOFCOM antidumping and safeguard investigation on industry injury as the main drafter under the assignment of IBII of MOFCOM;
• Assisting several multinational manufacturers respond to the antidumping and safeguard investigaitons conducted by China MOFCOM;
• Assisting several Chinese manufacturers to respond to Canadian, US, EU and Indian antidumping and countervailing investigations.
